A sheriff commented on the novelty of a “non-domestic non-harassment order” which was granted to keep a chronic shoplifter away from a shop instead of its normal use to prevent contact between an offender and his partner or former partner.

Mark McGeever (34) pleaded guilty to stealing a milkshake from the Spar store, in Charlotte Dundas Court, Grangemouth on December 8, 2019.

At Falkirk Sheriff Court on Thursday it was stated McGeever, 8 Charlotte Dundas Court, had been made subject to a non-harassment order – an undertaking normally associated with spouses and partners who have been victims of domestic offences – to stay away from the shop and have no contact with it.

Sheriff Derek Livingston, who noted this was a rare case of a “non-domestic non-harassment order” decided to defer sentence on McGeever until May 17 to call with other matters and transferred the case to Alloa Sheriff Court.
